PRAKTIK KEADILAN RESTORATIF DAN EFEKTIVITASNYA DALAM MENGURANGI RESIDIVISME
Abstract
ABSTRAK : Penelitian ini menyelidiki keampuhan keadilan restoratif dalam mengurangi residivisme dan elemen-elemen yang mempengaruhi keberhasilannya. Keadilan restoratif, sebuah alternatif dari sistem peradilan retributif, berfokus pada perbaikan hubungan antara pelaku, korban, dan masyarakat melalui percakapan dan reparasi. Menurut literatur, keadilan restoratif dapat mengurangi residivisme, meningkatkan kepuasan korban dan pelaku, dan memungkinkan rehabilitasi kerusakan. Namun, karakteristik pelaku dan korban, kualitas fasilitator, masalah budaya dan sosial ekonomi, serta desain dan implementasi program, semuanya berdampak pada keberhasilan keadilan restoratif. Tantangan yang dihadapi antara lain dukungan pemangku kepentingan, keragaman implementasi, integrasi dengan sistem hukum yang ada, sumber daya yang terbatas, dan bukti empiris tentang efektivitas. Terlepas dari tantangan-tantangan tersebut, keadilan restoratif memberikan pilihan yang lebih manusiawi dan rehabilitatif terhadap sistem pidana.

ABSTRACT : This study investigates the efficacy of restorative justice in reducing recidivism and the elements that impact its success. Restorative justice, an alternative to the retributive justice system, focuses on mending connections between offenders, victims, and communities via conversation and reparations. According to the literature, restorative justice can reduce recidivism, boost victim and offender satisfaction, and allow for harm rehabilitation. However, the characteristics of offenders and victims, facilitator quality, cultural and socioeconomic issues, and program design and implementation all have an impact on restorative justice's success. Challenges include stakeholder buy-in, implementation variability, integration with existing legal systems, limited resources, and empirical evidence of efficacy. Despite these challenges, restorative justice provides a more humanitarian and rehabilitative option to the criminal system.
